Restrictions on the ability of homeowners’ associations to enforce covenants deemed contrary to public policy have long been the norm in states across the country, including Colorado, which could soon see an expansion of such restrictions.

Colorado’s Common Interest Ownership Act (CCIOA) contains various statutory restrictions on the ability of a homeowners’ association to enforce rules and covenants deemed contrary to public policy.  For example, notwithstanding any provision in an association’s declaration, bylaws or rules and regulations to the contrary, an HOA is barred from enforcing prohibitions on xeriscaping, display of the American flag, and the display of political signs during election cycles.

Yesterday, Colorado Springs further solidified its standing as “Olympic City USA” with the grand opening of the United States Olympic and Paralympic Museum.  The 60,000 square foot state-of-the-art facility, soon to be connected to America the Beautiful Park via a 250-foot pedestrian bridge, cost $91 million to construct, and was aided by the Colorado Economic Development Commission’s 2013 dedication of up to $120.5 million of state sales tax revenue to Colorado Springs for its City for Champions initiative.  The initiative, designed to attract tourists to the City of Colorado Springs through the development of a host of unique destinations, includes the museum, the proposed Air Force Academy Gateway Visitor Center complex, a new downtown sports stadium, and the William J. Hybl Sports Medicine & Performance Center on the UCCS campus.

Homeowners operating short-term housing rentals in Denver will soon have a few more boxes to check prior to renting out their homes on popular hosting platforms such as Airbnb and VRBO.

While operators of short-term rentals are already required to be licensed by the City and County of Denver, new rules regarding the operation of short-term rentals in Denver are expected to be enacted next month, according to the Department of Excise and Licenses.
